Key Cash Advance Terms at a Glance

Annual Percentage Rate (APR): 4.55% to 32.80%. Your actual APR depends on your profile, income, state of residence, advance amount, repayment term, and the provider that makes you an offer. APRs will not exceed 32.80% and will not exceed the maximum rate permitted by applicable law.

Representative example. A $900 cash advance repaid over 12 months at an APR of 32.80% would have 12 monthly payments of $88.98. The total amount repaid would be $1,067.79, including a finance charge of $167.79. A $900 cash advance at an APR of 4.55% over 12 months would have 12 monthly payments of $76.86, for a total of $922.34 and a finance charge of $22.34. These examples assume on-time payments and no additional fees.

Extension example. If the same $900 cash advance at 32.80% APR were set up for a total term of 24 months, monthly payments would be $51.63 and the total repaid would be $1,239.07. A longer term lowers your monthly payment but increases the total cost.

Cash Aurivon does not offer cash advances with repayment terms of 60 days or less. Your exact APR, fees, payment schedule, and total cost will be disclosed by the provider before you accept any offer.

1. Acceptance of These Terms

These Terms of Use (“Terms”) govern your access to and use of the Cash Aurivon mobile application, website, and related services (together, the “Service”), operated by Cash Aurivon LLC, a Colorado limited liability company (“Cash Aurivon,” “we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

PLEASE READ SECTION 17 CAREFULLY. IT CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED.

2. Who We Are: Cash Aurivon Connects You with Providers

Cash Aurivon is a technology platform that connects consumers with independent third-party cash advance providers (“Providers”). Cash Aurivon does not fund cash advances, set their terms, or make approval decisions.

• All cash advance offers are made solely by Providers.
• Providers set all rates, fees, and terms, and decide whether to approve your request.
• Your cash advance agreement is between you and the Provider, not Cash Aurivon.
• We do not guarantee that you will receive any offer, or any particular amount, rate, or term.
• We are not an agent or representative of any Provider and do not endorse any particular offer.

Cash Aurivon may receive compensation from Providers when you are matched with them or when you accept an offer. This compensation does not increase the cost of your cash advance.

3. Eligibility

To use the Service, you must:

1. Be at least 18 years old (or the age of majority in your state, if higher);
2. Be a U.S. citizen or permanent resident residing in a state where the Service is available;
3. Have a valid Social Security number, email address, and mobile phone number;
4. Have an active checking account in your name at a U.S. financial institution;
5. Have a regular source of verifiable income; and
6. Meet any additional requirements a Provider applies to active-duty members of the U.S. Armed Forces and their dependents.

Meeting these criteria does not guarantee approval. Providers apply their own eligibility and review standards. The Service is not available in all states, and availability, amounts, and terms vary by state.

4. How the Service Works

1. Choose an amount. You select an amount between $200 and $900.
2. Submit your request. You provide accurate information about your identity, income, employment, and bank account.
3. Review offers. We share your request with one or more Providers, who may present offers.
4. Decide. You review each offer’s amount, APR, fees, payment schedule, and total cost. You are never obligated to accept any offer.
5. Finalize with the Provider. If you accept, you sign a cash advance agreement directly with the Provider, which handles funding, servicing, and collections.

Submitting a request does not commit you to accept a cash advance.

5. Cash Advance Offers and Disclosures

Every offer you receive will be accompanied by disclosures from the Provider, as required by applicable federal and state law, including the APR, finance charge, amount financed, total of payments, and payment schedule. Read these disclosures and the cash advance agreement carefully before accepting.

• APR range. APRs offered through the Service range from 4.55% to 32.80%. The APR you receive may differ from the rates shown in our marketing materials.
• Repayment term. Offers have repayment terms of 3 to 12 months.
• Credit checks. Providers may obtain your consumer credit report, including through soft or hard inquiries. A hard inquiry may affect your credit score.
• Credit reporting. Providers may report your payment history to one or more credit bureaus. Late or missed payments may harm your credit.
• Funding time. Funding times depend on the Provider and your bank. Instant or same-day funding is not guaranteed, and expedited delivery may carry an additional fee disclosed before you accept.

If there is any conflict between these Terms and your cash advance agreement, your cash advance agreement controls as to your cash advance.

6. Cash Advance Extension

If your Provider offers it and state law permits, you may request a one-time extension of your repayment term by up to 12 additional months, for a maximum total term of 24 months.

• Extensions are not automatic and are subject to the Provider’s approval.
• Your account usually must be in good standing to qualify.
• An extension lowers your monthly payment but increases the total cost of your cash advance.
• The APR on an extended cash advance will not exceed 32.80%.
• The Provider will give you updated disclosures showing your new payment schedule and total cost before the extension takes effect.

Extension requests are handled by your Provider. Cash Aurivon can help direct you to the right contact.

7. Fees

Cash Aurivon does not charge you a fee to use the Service, submit a request, or review offers. Any finance charge, origination fee, late fee, returned-payment fee, or expedited-funding fee is charged by the Provider and will be disclosed in your offer and cash advance agreement before you accept. If you miss a payment, contact your Provider right away to discuss options.

8. Consent to Share Your Information

By submitting a request, you authorize Cash Aurivon to share the information you provide with Providers and their service providers so they can evaluate your request, verify your identity, and present offers. You also authorize Providers to obtain consumer reports and to verify your income, employment, and bank account information. Our Privacy Policy explains how we collect, use, and share your information.

9. Electronic Communications and E-SIGN Consent

You consent to receive all agreements, disclosures, notices, and other communications from us and our Providers electronically, in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN). You agree that your electronic signature has the same legal effect as a handwritten signature. You may withdraw this consent by emailing support@cashaurivon.com, but doing so may prevent you from using the Service. To access electronic records, you need a device with internet access, a current web browser or our app, and a valid email address.

10. Calls, Text Messages, and Notifications

By providing your mobile phone number, you consent to receive calls and text messages from Cash Aurivon and our Providers about your request, account, and offers, including calls and messages sent using automated technology. Consent to marketing messages is not a condition of any purchase or cash advance. Message and data rates may apply. Reply STOP to opt out of text messages or HELP for help. You may also opt out by contacting us.

11. Your Account and Responsibilities

You agree to:

• Provide true, accurate, current, and complete information and keep it updated;
• Keep your login credentials confidential and notify us immediately of any unauthorized use;
• Use the Service only for lawful, personal, non-commercial purposes; and
• Borrow responsibly and only what you can afford to repay.

You may not submit a request on behalf of another person, use false or stolen information, interfere with the Service’s security or operation, scrape or copy the Service, or reverse engineer our app. Providing false information to obtain credit may violate federal and state law. We may suspend or terminate your access at any time if we believe you have violated these Terms.

12. Privacy

Your privacy matters to us. Our Privacy Policy describes what information we collect, how we use and protect it, and your choices, including rights you may have under state privacy laws such as the California Consumer Privacy Act. We protect your information with reasonable administrative, technical, and physical safeguards, but no system is completely secure.

13. Intellectual Property

The Service, including its software, design, text, graphics, logos, and the “Cash Aurivon” name, is owned by Cash Aurivon LLC or its licensors and is protected by U.S. and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended personal purpose. No other rights are granted.

14. Third-Party Services

The Service may link to or rely on third-party websites and services, including those of Providers, app stores, and bank-verification services. We do not control and are not responsible for their content, products, terms, or privacy practices. Your use of them is at your own risk and subject to their terms.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT YOU WILL RECEIVE ANY CASH ADVANCE OFFER. CASH AURIVON DOES NOT PROVIDE FINANCIAL, LEGAL, OR TAX ADVICE. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CASH AURIVON AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY ACTS OR OMISSIONS OF ANY PROVIDER, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED $100. Nothing in these Terms limits any right you may have under applicable consumer protection law that cannot be waived.

You agree to indemnify and hold Cash Aurivon harmless from claims arising out of your violation of these Terms or your submission of false information.

17. Dispute Resolution: Arbitration and Class Action Waiver

Informal resolution first. Before filing a claim, you agree to contact us at support@cashaurivon.com and try to resolve the dispute informally for at least 30 days.

Binding arbitration. Any dispute between you and Cash Aurivon arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court if it qualifies. We will pay AAA filing and arbitrator fees above the amount you would pay to file in court, unless the arbitrator finds your claim frivolous. The Federal Arbitration Act governs this Section.

Class action waiver. You and Cash Aurivon each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Right to opt out. You may opt out of this arbitration agreement by emailing support@cashaurivon.com with the subject “Arbitration Opt-Out” within 30 days after you first accept these Terms. Opting out will not affect any other part of these Terms.

Disputes about your cash advance are governed by the dispute resolution terms of your cash advance agreement with the Provider.

18. Governing Law

These Terms are governed by the laws of the State of Colorado and applicable federal law, without regard to conflict-of-law rules, except that consumer protection laws of your state of residence apply where required.

19. State Disclosures and Military Borrowers

• California residents: Cash advances arranged for California residents are subject to applicable California law. Under California Civil Code §1789.3, you may contact the Complaint Assistance Unit of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or (800) 952-5210.
• Colorado residents: Cash advances offered to Colorado residents are subject to applicable Colorado law, including the Colorado Uniform Consumer Credit Code where it applies.
• Military borrowers: Federal law provides important protections to active-duty members of the Armed Forces and their dependents. For covered members, the Military Annual Percentage Rate may not exceed 36%.
• Additional state-specific disclosures will be provided by your Provider where required.

20. Changes to These Terms and the Service

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before they take effect. Your continued use of the Service after the effective date means you accept the updated Terms. We may modify, suspend, or discontinue any part of the Service at any time.

21. General

These Terms, together with our Privacy Policy, are the entire agreement between you and Cash Aurivon about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
